D.C. Circuit vacates EPA monitoring rule

The U.S. Circuit Court of Appeals for the District of Columbia today tossed out a U.S. EPA rule that prevents states and local authorities from requiring additional air pollution monitoring at some industrial facilities. In a 2-1 decision, a three-judge panel vacated the 2006 rule that revised monitoring requirements under the Clean Air Act's Title V program for power plants, oil refineries, cement kilns and waste incinerators.
